1. Who we are and how these Terms work

1.1 These Terms and Conditions ("Terms") govern the services provided through buildyourbiz.com.au ("the Site") by Build Your Biz (ABN 24 574 400 946), the registered business name of the trustee for the Mann Family Trust ("we", "us", "our").

1.2 By purchasing a package or subscribing to a monthly plan through the Site, you ("you", "the customer") agree to these Terms. Please read them before paying.

1.3 We may update these Terms from time to time. The version in force when you purchase applies to that purchase.

2. What we provide

2.1 We sell fixed-price business setup packages and an optional monthly maintenance plan. Depending on the package purchased, our services include:

designing and building a simple, template-based website for your business, published to a domain registered in your name;

registering a domain name in your name and setting up associated business email;

creating and configuring accounts with third-party software providers in your name (for example ServiceM8 for job management and Stripe for payments), including loading your business details, job types, and quote/invoice templates;

setting up your Google Business Profile with details you provide, for you to verify with Google;

facilitating your business registrations (such as ABN, business name and GST registration) by guiding you through the relevant Australian Government online services; and

providing a personalised, general-information "Launch Plan" document.

2.2 The specific inclusions of each package are as described on the Site at the time of purchase.

3. What we do not provide (important)

3.1 We do not provide financial, tax, accounting, legal, insurance or migration advice, and nothing we supply (including the Launch Plan) is advice of those kinds. Information we provide is general in nature. You should obtain advice from appropriately licensed professionals for your circumstances.

3.2 We are not a registered tax agent, BAS agent or ASIC agent, and we do not lodge registrations on your behalf. Business registrations (including ABN, business name, and GST) are completed by you, using Australian Government online services, with our guidance. You are responsible for the accuracy of information you submit and for completing any identity verification those services require.

3.3 We do not provide trade licensing, insurance broking, or compliance certification. Requirements such as trade licences and insurance are your responsibility, and we may point you to public information or comparison services to assist you.

3.4 Third-party services configured for you (such as ServiceM8, Stripe, domain registration, and Google services) are provided by those third parties under their own terms, which you accept directly with them. Their fees (such as software subscriptions) are payable by you and are not included in our package price unless stated.

4. Price, government fees and payment

4.1 Package prices and the monthly plan price are as displayed on the Site, in Australian dollars, inclusive of GST.

4.2 Government fees (for example the ASIC business name registration fee) are not included in the package price. They are either paid by you directly to the relevant government service, or itemised separately at cost before you pay. We do not mark up government fees.

4.3 Payment is taken in advance through our payment provider (Stripe). We do not store your card details.

5. Your responsibilities

5.1 You agree to: provide accurate and complete information in our intake questionnaire; respond to reasonable requests promptly; complete identity verification steps required by government services and payment providers; review the materials we prepare (including your website) before and after publication; and use the services only for a lawful business.

5.2 You confirm you are entitled to use the business name, content, images and other materials you supply, and that they do not infringe any third party’s rights.

5.3 You are responsible for the ongoing operation of your business, including its registrations, licences, insurances, tax obligations, and dealings with your own customers.

6. Delivery timeframes

6.1 Timeframes we advertise or estimate (including any stated target of delivery within a specified number of hours) are targets, not guarantees, and depend on you completing verification steps promptly.

6.2 Some steps are controlled by third parties and government agencies — for example ATO or ASIC processing (including manual review of applications), Google verification, and payment-provider onboarding checks. Delays in those steps are outside our control and do not constitute a breach of these Terms.

7. Revisions, changes and the monthly plan

7.1 Each package includes one round of revisions to your website, to be provided by you as a single consolidated set of requested changes within 14 days of the draft being delivered.

7.2 Further changes are available under the monthly maintenance plan ("Keep Me Running") or by separate quotation.

7.3 The monthly plan covers: website hosting; domain and business email renewals; keeping configured software connected and up to date; reasonable content changes to your existing website requested via chat or email (not redesigns, new pages or new functionality); priority support; and a monthly summary. "Reasonable" means a volume and frequency of requests that is fair in the context of a $[39]/month service; we may discuss alternatives with you if usage substantially exceeds this.

7.4 The monthly plan is billed monthly in advance and may be cancelled by you at any time, effective at the end of the current billing period. On cancellation, your domain, website files, accounts and data remain yours (clause 8), and responsibility for future renewals and hosting passes to you. We will provide reasonable assistance to transition these to you.

7.5 We may cancel the monthly plan with 30 days’ notice, and will assist with transition as above.

8. Ownership — everything in your name

8.1 Your domain name, website content, business registrations, third-party software accounts, and customer data are yours. Where accounts must be created, we create them in your name wherever the provider permits.

8.2 We grant you a perpetual, royalty-free licence to use the website design and generated content we deliver to you, for your business. We may reuse underlying templates, know-how and generic components for other customers.

8.3 On request, we will supply you a copy of your website files.

9. Our use of technology and subcontractors

9.1 We use artificial-intelligence tools and third-party platforms to prepare websites, documents and other deliverables efficiently. All deliverables are reviewed by us before being provided to you.

9.2 We may use third-party service providers in delivering the services, and remain responsible to you for our services.

10. Referrals and commissions

10.1 Where we refer you to third-party services (for example insurance comparison services, accountants, or software providers), we may receive a referral fee or commission. Referrals are provided for your convenience and are not a recommendation or advice; you should assess any provider’s suitability yourself.

11. Consumer guarantees, refunds and problems

11.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL or any other law that cannot lawfully be excluded.

11.2 If something we deliver is not right, tell us and we will work with you to fix it promptly at no charge. Where the ACL entitles you to a remedy, we will provide it (which may include re-supply of the service or a refund, depending on whether the failure is major or minor).

11.3 Change of mind: as the services are customised and delivery begins promptly after purchase, refunds for change of mind are not provided once work has commenced, except as required by law.

12. Liability

12.1 Subject to clause 11.1, and to the maximum extent permitted by law: (a) our total aggregate liability to you in connection with the services is limited to the amount you paid us for the package (and, for the monthly plan, the fees paid in the 12 months preceding the event); and (b) we exclude liability for indirect or consequential loss, loss of profit, loss of revenue, and loss of business opportunity.

12.2 Where legislation implies a guarantee or condition that cannot be excluded but permits limitation, our liability is limited, at our option, to re-supplying the services or paying the cost of re-supply.

12.3 We are not liable for the acts, omissions, availability or performance of third-party providers or government services, or for decisions those parties make about your applications or accounts.

12.4 The trustee for the Mann Family Trust enters these Terms only in its capacity as trustee of that trust, and its liability is limited to the extent to which it is entitled to be indemnified out of the assets of the trust.

13. Privacy

13.1 We handle personal information in accordance with our Privacy Policy, available on the Site. Notably, we do not collect or store tax file numbers or identity documents; identity verification occurs directly with government services and payment providers.

14. Termination

14.1 We may decline or discontinue service (with a refund of amounts paid for undelivered work) if you provide false information, use the services unlawfully, or behave abusively toward our personnel.

15. General

15.1 These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

15.2 If any part of these Terms is found unenforceable, the remainder continues in effect.

15.3 These Terms, together with the package description at purchase and our Privacy Policy, are the entire agreement between us in relation to the services.
